TERMS OF SERVICE AGREEMENT

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY ACCESSING OR USING OUR WEBSITE, CREATING AN ACCOUNT, OR USING ANY OF OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS AND ALL POLICIES INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR USE OUR WEBSITE OR SERVICES.

ACCEPTANCE OF TERMS

These Terms of Service (the “Terms”) constitute a legally binding agreement between Gas & Brass Armory, located at [607 W Robertson St, Brandon, FL 33511] (“Gas & Brass Armory,” “we,” “us,” or “our”), and each person or business that accesses or uses our website or Services (“user,” “member,” “you,” or “your”).

These Terms govern your access to and use of the Gas & Brass Armory website, customer portal, software, integrations, tools, and related services (collectively, the “Site” and “Services”).

By creating an account or using the Services, you represent that you are at least 18 years old, have the legal authority to enter into these Terms, and, if acting on behalf of a business, have the authority to bind that business to these Terms.

SERVICES OFFERED

Gas & Brass Armory provides software-as-a-service tools designed to assist firearm dealers and other qualified businesses with ecommerce and supplier operations. Depending on your selected service plan, the Services may include:

  • GunBroker listing creation and management;

  • Supplier inventory and pricing synchronization;

  • Hourly listing and inventory updates;

  • Category, pricing, quantity, and shipping-profile controls;

  • MAP-aware pricing controls;

  • GunBroker order management;

  • Supplier dropship order workflows;

  • UPC-based product and supplier searches;

  • Product information, supplier cost, quantity, and MAP-price comparisons; and

  • Other related features made available through the Site.

The available features depend on your selected subscription plan, account status, supplier relationships, third-party credentials, and applicable integrations.

All visitors to the Site are considered “users” under these Terms. A user who creates an account or purchases a subscription may also be referred to as a “member.”

Subject to these Terms and your timely payment of all applicable fees, Gas & Brass Armory grants you a limited, non-exclusive, non-transferable, and revocable right to access and use the Services for their intended business purposes during your active subscription.

You may only use the Services in compliance with applicable federal, state, and local laws, firearm regulations, marketplace rules, supplier agreements, and carrier requirements. You are solely responsible for maintaining all licenses, permits, accounts, approvals, and Federal Firearms Licenses required for your business activities.

The Services may connect with third-party platforms and suppliers, including GunBroker, RSR Group, Sports South, Lipsey’s, Bill Hicks, MGE Wholesale, and Davidson’s. These companies are independent third parties and are not owned or controlled by Gas & Brass Armory. Your use of their services remains subject to their separate terms, policies, fees, availability, and account requirements.

Unless expressly stated otherwise, Gas & Brass Armory provides the software used to support your operations and does not act as the seller, distributor, marketplace, payment processor, freight carrier, or Federal Firearms Licensee for transactions conducted through your own marketplace or supplier accounts.

We do not guarantee that any particular product, supplier, integration, price, quantity, MAP price, listing, order, or third-party service will remain available or error-free. You are responsible for reviewing product information, prices, inventory, listings, orders, shipping information, and legal requirements before completing a transaction.

REFUND AND CANCELLATION POLICY

Gas & Brass Armory is a month-to-month subscription service. Unless otherwise stated during checkout, your selected service plan is billed every 30 days regardless of your level of usage.

Your subscription automatically renews at the end of each billing period until canceled. You authorize Gas & Brass Armory and its payment processor to charge your selected payment method for each recurring subscription payment.

You may cancel your subscription at any time. After cancellation, you will not be charged for a future billing period. Unless otherwise required by law, cancellation does not provide a prorated refund or credit for the remaining portion of the current billing period.

You remain responsible for all charges incurred before the effective date of cancellation, including subscription fees and any separate fees charged by marketplaces, suppliers, payment processors, shipping carriers, or other third parties.

If you cancel during the first 30 days following your initial signup, you may request a full refund of your first month’s subscription fee. This refund applies only to the subscription fee paid directly to Gas & Brass Armory. It does not include GunBroker fees, supplier charges, product costs, shipping charges, taxes, payment-processing fees, or other third-party expenses.

Refund requests must be submitted to [sales@gbaguns.com]. Gas & Brass Armory reserves the right to deny a refund where there is evidence of fraud, abuse, a violation of these Terms, or a previously issued refund for the same person, business, or related account.

FEES, PAYMENT, AND TAXES

You agree to pay all fees associated with your selected Services according to the prices displayed on our pricing or checkout pages. Subscription prices, included features, and available plans may be updated from time to time.

Any pricing change will apply prospectively and will not alter charges already paid. Where required, we will provide notice before a pricing change applies to an existing recurring subscription.

By providing a credit card or another payment method, you:

  1. Authorize Gas & Brass Armory and its payment processor to charge the payment method for your initial and recurring subscription fees;

  2. Represent that you are authorized to use the payment method;

  3. Agree to keep your billing and payment information accurate and current; and

  4. Accept responsibility for payment if the payment method is declined, expired, suspended, or otherwise unavailable.

Unless otherwise stated or required by law, subscription fees are charged in advance, payable in United States dollars, and non-refundable except as expressly provided in the Refund and Cancellation Policy.

Subscription fees paid to Gas & Brass Armory do not include GunBroker listing or transaction fees, supplier product costs, supplier order charges, shipping charges, taxes, payment-processing charges, or other third-party fees. You are responsible for all amounts charged through your marketplace, supplier, shipping, or other third-party accounts.

You are responsible for all applicable sales, use, excise, value-added, and similar taxes arising from your purchase or use of the Services, excluding taxes based on Gas & Brass Armory’s net income.

You must notify us of a suspected billing error or discrepancy within 90 days after the charge first appears on your billing statement. Failure to notify us within this period may result in a waiver of your right to dispute the charge, to the extent permitted by applicable law.

If payment cannot be collected or your account becomes delinquent, Gas & Brass Armory may restrict, suspend, or terminate your access to some or all Services. Suspension does not automatically cancel your subscription. Recurring charges may continue until you properly cancel the subscription, unless Gas & Brass Armory terminates it.

Suspension, cancellation, or termination of a Sell on GunBroker service may cause active GunBroker listings managed through the Services to be scheduled for ending. You remain responsible for reviewing your marketplace account and confirming the status of all listings and orders.
